Privacy Policy

CareLoop Inc. (“CareLoop”, “we”, “us”, or “our”) is committed to protecting your privacy. We have prepared this Privacy Policy to describe to you our practices regarding the Personal Data (as defined below) we collect from: (i) users of our website (“Visitors”), located at www.careloop.com (the “Site”); and (ii) Care Seekers, Care Providers, and other third parties using our Services (collectively, “Members” and together with Visitors, “users,” “you,” or “your”). Capitalized terms not defined in this Privacy Policy have the meanings given in our Terms of Use located at [https://careloopapp.com/legal/privacy-statement].

  1. Note About Children. We do not intentionally gather Personal Data from users who are under the age of 18. If a user under the age of 18 submits Personal Data to Company and we learn that the Personal Data is the information of a user under the age of 18, we will attempt to delete the information as soon as possible. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us. We will delete such information from our files as soon as reasonably possible.

  2. How We Collect Information. Personal Data means any information which, either alone or in combination with other information we hold about you, identifies you as an individual, including, for example, your name, address, telephone number, email address, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. “Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. We collect Personal Data and Anonymous Data, as described below.

    1. Information You Provide to Us.

      1. If you are a Care Provider, when you create an account to log in to our Site, we may collect Personal Data from you, such as your first and last name, birthdate, social security number, driver’s license number, criminal history, ethnicity, gender, religion, email and mailing address, phone number, work experience, salary/income, professional license numbers, education, professional and personal references, profile picture, professional skills and abilities, schedule availability, and bank information to facilitate direct deposit of earnings.

      2. If you are a Care Seeker, when you create an account to log in to our Site, we may collect Personal Data from you, such as your first and last name, birth date, gender, religion, email and mailing address, phone number, care services needed, health conditions, activities, profile picture, and credit card information to facilitate payment processing.

      3. If you are a Member other than a Care Provider or Care Seeker, such as a family member, when you create an account to log in to our Site, we may collect Personal Data from you, such as your first and last name, birthdate, social security number, driver’s license number, criminal history, ethnicity, gender, religion, email and mailing address, phone number, work experience, salary/income, professional license numbers, education, professional and personal references, profile picture, professional skills and abilities, schedule availability, care services needed, and health conditions. We retain information on your behalf, such as files and messages that you store using your account.

      4. If you provide us feedback or contact us via email, we will collect your name and email address, as well as any other content included in the email, in order to send you a reply.

      5. When you post messages or upload content within our Site (including in any CareLoop forum), the information contained in your posting will be stored on our servers and other users to whom you provide access, will be able to see it.

      6. We also collect other types of Personal Data that you provide to us voluntarily, such as your operating system and version, and other requested information if you contact us via email regarding support for the Services.

      7. We may also collect Personal Data, at such other points in our Site that state that Personal Data is being collected.

      8. Please note that you can choose not to provide us with certain information, but this may limit the features of the Site or Services you are able to use.

    2. Information Collected via Technology.

      1. To make our Site and Services more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

      2. We also use cookies and URL information to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a web site. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. Persistent Cookies can be removed by following Internet browser help file directions. 

      3. We may also use: (i) third party tracking services, such as Google Analytics, to track and analyze Anonymous Data from users of our Site and Services; and (ii) location-enabled services for Care Providers as a means to facilitate time card data. If you use the location-enabled services, CareLoop may receive information about your actual location (such as GPS signals sent by a mobile device or via your web browser when on the Site).

    3. Information Collected from You About Others. Users to our Site can invite other people to become CareLoop members by sending invitation emails via our Site. We store the email addresses that are provided to us and, if they are provided by a CareLoop Member, we will associate those email addresses with such Member’s account. We do not currently sell these email addresses or use them to send any other communication besides invitations (unless the email address is used in registration by a new CareLoop Member) but we may do so in the future. Recipients of invitations may unsubscribe by contacting us at CareLoop-support@sharecare.com to request that we refrain from sending them emails or to have us delete their information in accordance with this Privacy Policy.

    4. Information Collected from Others About You. Other CareLoop Members may provide us Personal and/or Anonymous Data about you through our Site or the Services. Examples include when a Care Seeker posts feedback regarding a Care Provider or when another CareLoop Member (including a Care Seeker’s healthcare provider) submits health information to any CareLoop forum. If you are a Care Seeker, we will collect certain Personal Information about you via the applicable Care Provider, such as information they collect as part of their performance of certain health tasks and or the completion of certain questions/requirements under a care plan provided by you. 

    5. Information Collected from Third Party Companies. We may receive Personal and/or Anonymous Data about you from companies that assist CareLoop in providing the Services, such as BackgroundsOnline, or companies that offer their products and/or services on our Site. These third-party companies may supply us with your Personal Data. We may add this information to the information we have already collected from you via our Site in order to provide and improve the Services.

  3. Use of Your Personal Data.

    1. General Use. In general, Personal Data collected by us is used either to respond to requests that you make, or to aid us in serving you better. We may use your Personal Data in the following ways:

      1. to facilitate the creation of and secure your account on our network;

      2. identify you as a user in our system;

      3. run a background check and verify your credentials (if you are a Care Provider);

      4. provide improved administration of our Site and Services;

      5. provide the Services and customer support you request;

      6. improve the quality of experience when you interact with our Site and Services;

      7. tailor the features, performance and support of the Site or Services to you;

      8. send you a welcome email to verify ownership of the email address provided when your account was created;

      9. send you administrative email notifications, such as security or support and maintenance advisories;

      10. respond to your inquiries related to employment opportunities or other requests;

      11. respond to your requests, resolve disputes and/or troubleshoot problems;

      12. to make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback;

      13. to send newsletters, surveys, offers, and other promotional materials related to our Services and for other marketing purposes of CareLoop;

      14. customize the advertising you may see on the Site or through the Services;

      15. collect and/or distribute money; and

      16. verify your compliance with your obligations in our Terms of Use or other CareLoop policies.

    2. Creation of Anonymous Data. We may create Anonymous Data records from Personal Data by excluding information (such as your name) that make the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content of our Services and improve Site navigation. CareLoop reserves the right to use Anonymous Data for any purpose and disclose Anonymous Data to third parties in its sole discretion.

  4. Disclosure of Your Personal Data. We disclose your Personal Data as described below and as described elsewhere in this Privacy Policy.

    1. Other CareLoop Members. We may share your Personal Data with third parties to whom you ask us to send Personal Data, including other Members. Unless you direct us to share to your Personal Data via your “Privacy Settings” or otherwise, we do not disclose the Personal Data of any Care Seeker or Care Provider to any another Member. We do, however, provide other Members with the opportunity to communicate with you through a web-based message box. If you respond to any in-browser message, you will be providing the recipient your name and allowing them to continue to message you.

    2. Third Party Service Providers. We may share your Personal Data with third party service providers to: provide you with the Services that we offer you through our Site; to conduct quality assurance testing; to facilitate creation of accounts; to provide technical support; and/or to provide other services to CareLoop. Examples of such third-party service providers include companies that administer background checks of Care Providers and companies that process payments from both Care Providers and Care Seekers. These third-party service providers are required not to use your Personal Data other than to provide the services requested by CareLoop.

    3. Affiliates and Acquisitions. We may share some or all of your Personal Data with our parent company, subsidiaries, joint ventures, or other companies under common control with us (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy. If another company acquires our company, business, or our assets, by way of any transaction including a merger or bankruptcy proceedings, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy.

    4. Other Disclosures. Regardless of any choices you make regarding your Personal Data (as described below), CareLoop may disclose Personal Data if it believes in good faith that such disclosure is necessary: (i) in connection with any legal investigation; (ii) to comply with relevant laws or to respond to subpoenas or warrants served on CareLoop; (iii) to protect or defend the rights or property of CareLoop or users of the Services; and/or (iv) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy or Terms of Use.

  5. Information Collected by Other Third Parties. This Privacy Policy addresses only our use and disclosure of information we collect from and/or about you. If you disclose information toothers, including to other CareLoop Members, the use and disclosure restrictions contained in this Privacy Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. In addition, information made available through the Service by Members may be protected by applicable privacy laws, including the Health Insurance Portability and Accountability Act. Also, the Site may contain links to other websites that are not owned or controlled by us. We have no control over, do not review and are not responsible for the privacy policies of or content displayed on such other websites. When you click on such a link, you will leave our Site and go to another site. During this process, another entity may collect Personal Data or Anonymous Data from you. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites.

  6. Privacy Rights and Choices; Account Termination. Our goal is to be clear about what information we collect, so that you can make meaningful choices about how it is used. Notwithstanding anything herein to the contrary, your right to access or delete the Personal Information we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refrain from taking certain actions with respect to some or all of the Personal Information that we hold about you. In addition, some or all of the Personal Information may have been destroyed, erased or made anonymous. In the event we cannot provide you with access to your Personal Information, or we are unable to delete it, we will inform you of the reasons why, subject to any legal or regulatory restrictions. Subject to your specific use of the Services, your privacy rights include:

    1. Transparency and the Right to Information. Through this policy we explain how we use and share your information. However, if you have questions or need additional information you can contact us any time at [feedback@careloopapp.com].

    2. Right of Access, Restriction of Processing, Erasure. You may contact us to request information about the Personal Information we have collected from you, or to request that your Personal Information be deleted. We will do our best to honor your requests, subject to any legal, ethical and contractual obligations. To make a request or to ask us a question about our data practices, please use our privacy webform [https://careloopapp.com/], contact us via email at [feedback@careloopapp.com], or make use of the self-service tools in the “Settings” menu of your mobile app, if applicable. When requesting access to your Personal Information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the Personal Information that we hold about you. You may designate an authorized agent to request information on your behalf, provided that the authorized agent complies with our verification procedures to ensure your permission has been obtained. 

    3. Right to Termination. You may terminate your account with us at any time through the account settings or by contacting [feedback@careloopapp.com]. Terminating your account will revoke any applicable consents or opt-ins but will not necessarily delete all of your data.

    4. Right to Correct Your Information. We endeavor to ensure that Personal Information in our possession is accurate, current and complete. If an individual believes that the Personal Information about him or her is incorrect, incomplete or outdated, he or she may request the revision or correction of that information. We reserve the right not to change any Personal Information we consider accurate. If it is determined that Personal Information is inaccurate, incomplete or outdated, we will use reasonable efforts to revise it and, if necessary, use reasonable efforts to inform agents, service providers or other third parties, which were provided with inaccurate information, so records in their possession may be corrected or updated.

    5. Right to Withdraw Your Consent. When we process your Personal Information based on your consent, you have the right to withdraw that consent at any time. You may withdraw your consent by contacting us at [feedback@careloopapp.com].

    6. Right to Object or Opt Out. You have the right to object at any time to receiving marketing or promotional materials from us by either following the opt-out instructions in commercial e-mails or by contacting us, as well as the right to object to any processing of your Personal Information or to participating in any program. We will consider any request you make to us, and provide a reply in a timely manner, according to our legal, ethical and contractual obligations. Some non-marketing communications are not subject to a general right to opt out, such as communications about transactions and disclosures to comply with legal or ethical requirements.

    7. Right to Data Portability. You have the right to data portability of your own personal data by contacting us. There are instances where applicable law or regulatory requirements allow or require us to refrain from transmitting your Personal Information to certain recipients or may require additional documentation before transmitting your information. In addition, some or all of the Personal Information may have been destroyed, erased or made anonymous. In the event we cannot fulfill your data portability request or require additional information to do so, we will contact you.

    8. Right Not to be Subject to an Automated Decision. We do not make automated decisions using your Personal Information that may negatively impact you.

    9. Right to Lodge a Complaint with the Competent Regulatory Authority. This may include your state’s attorney general, if you believe that the processing of your Personal Information does not comply with the applicable legal requirements.

    10. Right to Control With Whom You Share Information. This is managed through your device’s privacy settings.

  8. Throughout this Privacy Policy, we discuss the specific pieces of “personal information” (as defined in the CCPA) that we collect from and about users of our Site and Services. In accordance with the California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”), we are providing you with additional information about the personal information we collect from California residents, how we disclose that personal information, and your privacy rights.

  9. Personal Information We Collect, Use, and Disclose

  10. As discussed throughout this Privacy Policy, we collect personal information directly from you, from our vendors and clients, and from the cookies and tracking technologies we use. The specific categories of personal information vary depending on the Site or Services you engage with and how you use them. In the past year we have collected and anticipate continuing to collect the following types of personal information from users and visitors of our Site and Services. For each category of personal information, we provide additional details about how we use and disclose the personal information we collect.

  11. Identifiers and Other Non-Public Personal Information as described in California Civil Code § 1798.80(e), including, for example, name, address, email address, phone number, driver’s license, and/or IP address. We may use this personal information to provide services you have requested from us; to respond to inquiries; to service your account; for our day-to-day business operations; to protect against fraud or unauthorized transactions; and for safety and compliance. We may disclose your personal information within our corporate group and to our vendors and business partners to ensure security and integrity of our Site and Services; to provide services you request; as reasonably necessary to operate our business, including internal research and development; to perform activities to verify or maintain the quality or safety of our systems, Site, and Services and to improve, upgrade, or enhance them; to identify and repair errors in the functionality of our systems, Site, or Services; to detect and prevent illegal or malicious acts or violations of our policies or terms; and, as needed, to use for other short-term, transient purposes.

  12. Characteristics of Protected Classifications, including, for example, gender or gender identity, health/medical conditions, and/or information obtained from a background check. We may use characteristics of protected classifications to provide services you have requested from us; to respond to inquiries; to service your account; and for safety and compliance. We may disclose your characteristics of protected classifications within our corporate group and to our vendors and business partners to ensure the security and integrity of our Site and Services; to provide services you request; and as reasonably necessary to operate our business, including internal research and development; and to detect and prevent illegal or malicious acts or violations of our policies or terms.

  13. Commercial Information, including, for example, transaction data, purchase or use history or tendency, financial data (such as payment method details and billing address), and/or Services purchased, obtained, or considered. We may use commercial information to provide services you have requested from us; to evaluate and improve our Site and Services; to respond to inquiries; for our day-to-day business purposes; to service your account; to help us better understand your preferences; to enhance your experience by personalizing our Site and Services; to protect against fraud or unauthorized transactions; and for safety and compliance. We may disclose your commercial information within our corporate group and to our vendors and business partners to ensure the security and integrity of our Site and Services; to provide services you request; as reasonably necessary to operate our business, including internal research and development; to detect and prevent illegal or malicious acts or violations of our policies or terms; and, as needed, to use for other short-term, transient purposes.

  14. Internet or Other Electronic Network Activity, including, for example browsing history, search history, and/or information regarding your interactions with our Site. We may use internet or other electronic network activity to provide services you have requested from us, including access to our Site features; for our day-to-day business purposes, including development or improvement of our Site and Services; to service your account; to protect against fraud or unauthorized transactions; and for safety and compliance. We may disclose your internet or other electronic network activity within our corporate group and to our vendors and business partners to ensure security and integrity of our Site and Services; to provide services you request; to perform functions needed to operate our business, including internal research and development; to perform activities to verify or maintain the quality or safety of our systems, Site, and Services and to improve, upgrade, or enhance them; to identify and repair errors in the functionality of our systems, Site, or Services; to detect and prevent illegal or malicious acts or violations of our policies or terms; and, as needed, to use for other short-term, transient purposes.

  15. Geolocation Information, including, for example, information about the approximate location of you or your device as well as the precise GPS location of your device if you agree to turn this functionality on through the Services or your device settings. We may use geolocation information to provide services you have requested from us, such as recommending Care Providers in your area; to enhance your experience by personalizing our Site and Services; to protect against fraud or unauthorized transactions; and for safety and compliance. We may disclose your geolocation information within our corporate group and to our vendors and business partners to ensure security and integrity of our Site and Services; to provide services you request; as reasonably necessary to operate our business; to identify and repair errors in the functionality of our systems, Site, or Services; to detect and prevent illegal or malicious acts or violations of our policies or terms; and, as needed, to use for other short-term, transient purposes.

  16. Audio, Visual, or Other Similar Information, including, for example, voice recordings from customer service calls and/or photos you upload to your profile or job posting. We may use this information to provide services you have requested from us; to respond to inquiries; to service your account; for our day-to-day business operations including development or improvement of our Site and Services; to protect against fraud or unauthorized transactions; and for safety and compliance. We may disclose your information within our corporate group and to our vendors and business partners to ensure security and integrity of our Site and Services; to provide services you request; as reasonably necessary to operate our business, including internal research and development; to perform activities to verify or maintain the quality or safety of our systems, Site, and Services and to improve, upgrade, or enhance them; to identify and repair errors in the functionality of our systems, Site, or Services; and to detect and prevent illegal or malicious acts or violations of our policies or terms.

  17. Professional or Employment-Related Information, including, for example, Care Provider references, employment history, and/or certifications. We may use this professional information to provide services you have requested from us, including matching Care Providers with Care Seekers; to respond to inquiries; to create and service your Care Provider profile and account; for our day-to-day business operations; to protect against fraud or unauthorized transactions; and for safety and compliance. We may disclose your professional information within our corporate group and to our vendors and business partners to ensure security and integrity of our Site and Services; to provide services you request; as reasonably necessary to operate our business, including internal research and development; to perform activities to verify or maintain the quality or safety of our systems, Site, and Services and to improve, upgrade, or enhance them; and to detect and prevent illegal or malicious acts or violations of our policies or terms.

  18. Inferences we draw from information we collect about you to create a profile of you, including, for example, information reflecting your inferred preferences and interests. We may use inferences to provide services you have requested from us, including matching Care Providers with Care Seekers and other content or information customization; for our day-to-day business operations; to protect against fraud or unauthorized transactions; and for safety and compliance. We may disclose inferences about you within our corporate group and to our vendors and business partners to ensure security and integrity of our Site and Services; to provide services you request; as reasonably necessary to operate our business, including internal research and development; to perform activities to verify or maintain the quality or safety of our systems, Site, and Services and to improve, upgrade, or enhance them; to identify and repair errors in the functionality of our systems, Site, or Services; and to detect and prevent illegal or malicious acts or violations of our policies or terms.

  19. Sensitive Personal Information, including, for example, your account login credentials, precise geolocation information, contents of communications between Care Providers and Care Seekers on our Site, and/or health data. When collected, we only use or disclose sensitive personal information for the purposes allowed by the CCPA and its implementing regulations in connection with our legitimate business purposes  We may use or disclose sensitive personal information when reasonably necessary to provide services you have requested from us or expect us to provide; to protect your physical safety or that of others; for our day-to-day business operations, including servicing your account and providing customer service; to protect against fraud or unauthorized transactions; to perform activities to verify or maintain the quality or safety of our systems, Site, and Services and to improve, upgrade, or enhance them; and to detect and prevent illegal or malicious acts or violations of our policies or terms.  Please note that given our limited uses of sensitive personal information for legitimate business purposes, we do not offer a “Right to Limit” under the CCPA.

  20. In addition to the uses and disclosures of personal information described above, we may use and disclose any personal information we collect or maintain as reasonably necessary to comply with law and legal requirements; to cooperate with and respond to law enforcement requests; or as otherwise required by applicable law, court order, governmental regulation, or other legal process. 

  21. Any personal information we collect and maintain may be provided to our professional advisors, including accountants, auditors, consultants, and lawyers, when reasonably necessary for our professional advisors to perform services for us and give us appropriate advice. 

  22. Any personal information we collect and maintain may be given to another company in the event of a sale, merger, or other acquisition of some or all of our assets or business or as part of the negotiation or evaluation of such sale, merger, or other acquisition.

  23. Our Retention of Personal Information.  For detailed information about our retention practices, please see the “How We Protect Information and Information Retention” section above.

  24. California Privacy Rights

  25. California residents may make certain requests about their personal information under the CCPA as set forth in “Your Rights and Choices” section above. 

  26. In addition, if we offer any financial incentives in exchange for your personal information, we will provide you with appropriate information about such incentives.

  27. Right to Opt Out of “Sale” or “Sharing” of Personal Information. The CCPA requires that we describe certain disclosures of personal information where we receive valuable consideration. California law treats such disclosures as “sales” even if no money is exchanged. The CCPA also requires us to disclose how we “share” personal information, i.e., how we disclose personal information for purposes of cross-context behavioral advertising (also called targeted advertising). Such activities are described more in the Policy above.

  28. To opt out of our use of your personal information through cookies and similar technologies for purposes that are considered “sales” or “sharing,” you can use the “Your Privacy Choices” or “Do Not Sell or Share My Information” link on our Site footer. If you have a legally recognized browser-based opt out preference signal turned on through your browser, we recognize the preference expressed by this signal in accordance with applicable law.  

  29. We do not knowingly sell the personal information of minors under 16 years of age.

  30. Do Not Track Notice. Some browsers used to access the Internet may give you the option through “Do Not Track” settings associated with such browsers to request that a website operator not track your information across its website or other websites. We engage in such tracking in order to optimize and/or customize our Services, detect and respond to allegations of fraud, and to otherwise ensure the safety of our Registered Users and Site Visitors. While we do not currently honor such browser requests, we will not use your information in a manner that violates this Privacy Policy.  Please note that Do Not Track is a different mechanism than the “Global Privacy Control” discussed immediately above, which we do honor.

  31. Shine the Light. California Law allows customers who are California residents to request certain information once per year regarding our disclosure of “personal information” (as that term is defined under applicable California law) to third parties for such third parties’ direct marketing purposes.]. CareLoop does not sell your personal information or share your personal information for purposes of cross-context behavioral advertising.

  32. Security of Your Personal Data. CareLoop is committed to protecting the security of your Personal Data. We use a variety of industry-standard security technologies and procedures to help protect your Personal Data from unauthorized access, use, or disclosure. We also require you to enter a password to access your account information. Please do not disclose your account password to unauthorized people. No method of transmission over the Internet, or method of electronic data storage, is 100% secure, however. Therefore, while CareLoop uses reasonable efforts to protect your Personal Data, CareLoop cannot guarantee its absolute security.

  33. Users Outside of the United States; Location of Processing. CareLoop does not currently offer its services outside of the United States. If you interact with our websites or mobile application, whether within or outside of the United States, your Personal Data may be processed in the country in which it was collected and in other countries, including the United States, the Philippines, and Guatemala.

  35. Changes to This Privacy Policy. This Privacy Policy is subject to occasional revision, and if we make any material changes in the way we use your Personal Data, we will notify you by sending you an email to the last email address you provided to us and/or by prominently posting notice of the changes on our Site. Any changes to this Privacy Policy will be effective upon the earlier of 30 calendar days following our dispatch of an email notice to you or 30 calendar days following our posting of notice of the changes on our Site. These changes will be effective immediately for new users of our Service. Please note that at all times you are responsible for updating your Personal Data to provide us with your most current email address. In the event that the last email address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the email containing such notice will nonetheless constitute effective notice of the changes described in the notice.
